Below you will find our rental agreement and information like the Terms and Conditions of this villa rental, our payment, and cancellation policies, check-in and check-out time, services including wheelchair access, and most IMPORTANT what you need to know about your arrival on the island. Please take the time to read the rental agreement and enjoy your stay at MoonSwept Villa.

TERMS AND CONDITIONS OF THIS VILLA RENTAL:
When you make a reservation, you will receive a Vacation Rental Confirmation/Invoice from us requesting your deposit on Moonswept Villa. This Vacation Rental Confirmation becomes a binding agreement when you send us your rental deposit; it states the terms and conditions concerning this villa rental between you (the “Guest”) and your principal, Garry Dial. Your sending payment in response to this invoice constitutes your acceptance and agreement to these terms, conditions, limitations, and restrictions as printed below. If you have any problems or questions with any of the following, please be sure to phone us for discussion and explanation before you send us your rental deposit monies.

OUR PAYMENT AND CANCELLATION POLICIES:

Half of your rent is due within 2 days of booking to confirm your reservation. You can write a check made out to Garry Dial and send a picture of the front and the back of your check to msvstjohn@gmail.com. While that is the simplest way to pay you can also choose to use Paypal. Our bookkeeper will send you the instructions for using Paypal.

Failure to make this payment subjects your reservation to automatic cancellation. The balance due of rent and taxes must be paid in full at least 60 days prior to your arrival.

PLEASE PURCHASE TRIP INSURANCE FOR YOURSELF. THIS IS VERY IMPORTANT!

Moonswept Villa has a no-refund policy. If you cancel your reservation you will not receive a refund.

 COVID-19 CANCELLATION POLICY:

IF ST. JOHN IS SHUT DOWN TO INCOMING TRAVELERS DUE TO COVID-19, YOU WILL HAVE THE OPTION OF RECEIVING A REFUND OR MOVING YOUR RESERVATION TO A LATER DATE.

LIABILITY:
Garry Dial assumes no liability for property loss or damages, nor liability for injury, accidents, delay, or irregularity which may be occasioned either by reason of a defect in any vehicle or the acts of any company or persons engaged in conveying passengers to or from their villa. Transportation (airlines, ferries, charter vessels, rental cars, and taxis) is supplied by providers who operate independently of Garry Dial. He assumes no responsibility, therefore, for any loss, injury, or damage to person or property because of the acts of those providers. Furthermore, Guest is responsible for his villa during occupancy, must lock villa’s windows and doors securely at all times when not on the premises, and must exercise care in securing all personal property. Garry Dial reserves the right to refuse service or rentals to anyone at his complete discretion.

NO PETS:
Pets of any kind are NOT allowed in or on the villa’s premises without specific written permission from Garry Dial (granted prior to arrival). A pet or evidence of a pet found on premises will cause immediate eviction, and forfeiture of Guest’s entire rent and deposit.

NO SMOKING:
Moonswept is a smoke-free villa. No smoking anywhere in the villa. You can smoke outside if you wish.

SECURITY DEPOSIT:

There is a security deposit of $300 which will be refunded to you after your stay provided there are no damages.

TWO NEW FEATURES!

For an additional charge of $40 per day you can choose to have the POOL HEATED.

For an additional charge of $40 per day you can choose to have AIR CONDITIONING IN THE GREAT ROOM. The air conditioning in the bedrooms are included in your rental fee.

You can apply the security deposit toward these charges if you opt to use them.

RENTAL VEHICLE:
You will need to rent a 4-wheel drive vehicle to get to Moonswept. This is not difficult as most of the rental cars are a 4-wheel drive.

COMPLAINTS AND MAINTENANCE:
Garry Dial shall make every effort to keep Moonswept Villa and it’s inventory in good working order. In case of a maintenance problem, he will strive to repair the problem as soon as possible after being notified. He reserves the right to be allowed several hours (up to 24 hours) to cure a reported problem. However, no refund or rate adjustment shall be made for unforeseen mechanical failures such as the supply of electricity, telephone service, internet service, water, pool filtration systems, hot tubs, air conditioning, television or cable service, appliances, etc. It is the Guest’s obligation to report any problems or damage to the villa IMMEDIATELY to the Villa Managers, Kelly Lawson, and Bryan McKinney, regardless of the hour.

CHECK-IN and CHECK-OUT TIMES:
Guests must vacate their villas no later than 9 AM, and check-in time is 4 pm – NO EARLIER! If you would like a later check-out time, you are required to check with the Villa Manager during your stay to see if another group is arriving the day you leave. If not, you might be able to stay on later into the afternoon at no charge, but you are required to get prior permission to stay later than the published check-out time.

ENTRY INTO VILLA:
The Villa Managers may enter your villa to perform any repairs as necessary. However, they will never enter the villa or the grounds around the pool deck without notifying you first.

DRUGS AND HAZARDOUS MATERIALS:
Guest and members of his party shall not use or permit to be brought into the villa any illegal substances, inflammable fluids (e.g., gasoline, kerosene, naphtha or benzene), or other explosives or articles deemed hazardous to life, limb or property.

VILLA KEYS:
Garry Dial shall charge Guest $25 for each set of lost or mishandled keys. Guest is required to follow all instructions precisely on where to leave your villa keys when you depart – call our Villa Managers if you are unsure!

CAPACITY OF VILLA:
The total number of persons allowed to stay in the villa at any one time is restricted to the number of persons scheduled and paid for, based on two persons per bedroom. Should a group misrepresent themselves, they will be required to pay for all excess persons immediately or shall vacate the villa without refund.

QUIET ENJOYMENT AND PARTIES:
Moonswept Villa wishes to maintain a family atmosphere for the quiet enjoyment of Guests. We rent to family groups and responsible adults only; absolutely NO house parties or functions such as weddings are allowed without advance WRITTEN permission from Garry Dial. Guests shall be sufficiently quiet and peaceful, so as not to disturb other residents of the neighborhood, particularly after 10 pm at night.

In any dispute arising out of this rental agreement, the laws of the United States Virgin Islands shall apply and the prevailing party shall recover its costs, expenses and reasonable attorneys’ fees. This Vacation Rental Agreement Confirmation becomes a binding agreement when you send Garry Dial your rental deposit. Your sending payment in response to this invoice constitutes your acceptance and agreement to these terms, conditions, limitations, and restrictions as printed above. SOME VERY IMPORTANT NOTES FOR YOUR INFORMATION
PLEASE READ CAREFULLY!

YOUR ARRIVAL ON ISLAND – IMPORTANT! 

You will fly into the Cyril King Airport in St. Thomas. You have a choice of renting your car. You can rent at the airport and drive to the ferry dock where you will catch the boat to St. John. Or you can take a taxi to the ferry and rent a car when you arrive on the island of St. John. Please note that if you choose to rent a car on St. John, it cannot be taken over to the island of St. Thomas.

We will need to know your airline FLIGHT NUMBER, ARRIVAL AND DEPARTURE TIMES, AND YOUR CAR RENTAL COMPANY at least THREE WEEKS before you travel (please email this vital information to Kelly Lawson at kellylawson42@gmail.com.) This is essential. Always travel with your list of island contact numbers in case of emergencies. And be sure you remember to bring your passport OR your original (or certified copy) birth certificate with a photo ID. [U.S. PASSPORTS ARE NOW REQUIRED TO GAIN ENTRY BACK INTO THE UNITED STATES IF YOU ARE PLANNING A DAY TRIP TO TORTOLA, VIRGIN GORDA, or ANEGADA .] If your flight is delayed or canceled while en route, please contact Kelly Lawson so she can notify everyone involved, including your car rental company –failure to do this will result in a $50 penalty. You may phone Kelly at 512-949-9564. We are on Atlantic Standard Time (during the winters, this is one hour ahead of New York’s time).

Once you have arrived on St. John you will get your rental car (if you’ve chosen to rent on St. John) or simply proceed to Coral Bay where Kelly or Bryan will meet you and take you up to Moonswept Villa. Upon arrival at the villa, you’ll be given your keys and an island and villa orientation to get you settled and comfortable. These “meet-and-escort” services are included in your rental rate; there is no extra charge for these services, although a tip for your escort is at your discretion for excellent service. You’ll also have the Villa Manager’s day and night phone numbers for contact in case you need anything (even advice!) during your island vacation. However, transportation back to the airport or ferry dock upon your departure is NOT provided or included. Please be sure that you rent a vehicle large enough for your entire party PLUS your luggage! Island rental cars are usually small compact models, and jeeps will hold four passengers but little to no luggage – please plan accordingly.

You are required to phone (or text) the Villa Manager before you board the ferry or car barge from St. Thomas to St. John, so she will know at what time to expect you in Coral Bay. Please be sure to travel with all island contact numbers! You may rent a car on St. Thomas and barge it to St. John for your stay (except Hertz cars); for complete information on barge schedules and fares, please ask the Villa Manager. The St. John passenger ferry from Red Hook (East End) charges $6 one way, plus $4 per piece of luggage, and the trip is about 20 minutes. Due to heightened security, all passengers are now required to tag all pieces of their baggage, and to travel with their photo I.D.s, which may be checked at boarding on all ferries. Luggage tags are for sale for $4 each at the ferry ticket booths. Prices are subject to change.

MAID SERVICE:
We send in a cleaning service before your arrival and after your departure so that your villa is very clean. If you require mid-stay or daily maid service it is available at an extra charge. This must be arranged with Garry Dial and the Villa Manager prior to the first deposit. Please request pricing for these needs upon booking. This service is for hotel-type general cleaning and tidying only; any personal laundry, cooking, or babysitting must be arranged in advance, and prices set according to services required. We’ll be happy to book these extra services for your vacation.

GROCERY DELIVERY and A CHEF FOR YOUR VILLA STAY:
With at least 3 weeks advance notice, we can pre-stock your villa with the food and beverages of your choice. So, especially if you are arriving in the afternoon or traveling with small children, let us deliver your custom grocery order to your villa just before your arrival. There is an extra charge for this service. For these and all other needs, please contact our Villa Manager.

TIPPING THE VILLA’S STAFF:
For really excellent service with a smile, we recommend tipping about $20 to $30 per week for each housekeeper. And if you have food and drink left in your villa when you depart, you may also leave these for the housekeeping staff – they will appreciate it.

STAIRS:
Our island is mostly very hilly which provides dramatic sweeping vistas from many locations. One of the beauties of Moonswept Villa is that you walk straight out of your car to the front door without having to negotiate stairs. Once inside everything is on one level, including access to the pool, and the doors have been made wide enough to accommodate a wheelchair if necessary.
